TRANSAKSI JUAL-BELI TERLARANG: GHISY ATAU TADLIS KUALITAS (PENIPUAN ATAU KECURANGAN)

Abstract


This research explains the concept of tadlis in the perspective of Islamic Law, Tadlis means the practice of transactions conducted by a person by hiding information to the transaction of buying and selling. Tadlis is divided into four categories, namely tadlis in quantity, tadlis in quality or ghisy, tadlis in price, and tadlis in the time of submission. Ghisy is a concealment of defective goods and mixing between good quality goods and poor
quality. The steps that can be used to avoid this ghisy, among them wary of the potential for harm and tyranny. Substantially ghisy or fraudulent practice is contained in clause in Law Number 8 Year 1999 on Consumer Protection (article 1). This law also becomes the umbrella of government law in protecting sellers or buyers from transactions containing fraudulent elements, which explains the rights and obligations of consumers.
